Terms of Service

1. Agreement to Terms
By accessing or using TraceFox (“the Service”), operated by TraceFox GmbH (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including individual users and teams.
2. Account Registration
To use TraceFox, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access. We reserve the right to suspend accounts that violate these terms.
3. Acceptable Use
You agree not to use TraceFox to:
- Violate any applicable laws or regulations.
- Infringe on the intellectual property rights of others.
- Upload or transmit malicious software, viruses, or harmful code.
- Attempt to gain unauthorized access to other users' accounts or data.
- Use the Service in a way that could damage, disable, or impair its functionality.
- Reverse-engineer, decompile, or disassemble any part of the Service.
4. Intellectual Property
You retain ownership of all content you create within TraceFox, including requests, evidence, artifacts, and project knowledge. We do not claim any intellectual property rights over your content. The TraceFox service, including its design, code, and documentation, is owned by TraceFox GmbH and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
5. Subscription and Payments
TraceFox offers free and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. Prices are listed on our pricing page and may be updated with 30 days' notice. Refunds are provided at our discretion. If payment fails, we may suspend access to paid features after a reasonable grace period. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
6. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We will make reasonable efforts to notify users of planned maintenance in advance. We are not liable for any losses resulting from service interruptions.
7. Data and Privacy
Your use of TraceFox is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. You are responsible for ensuring that any data you upload to TraceFox complies with applicable data protection laws, including obtaining necessary consents from third parties whose data you may process through the Service.
8. Limitation of Liability
To the maximum extent permitted by law, TraceFox GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
9. Termination
You may terminate your account at any time by contacting us or using the account settings. We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow for data export, after which it will be permanently deleted.
10. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of TraceFox after the changes take effect constitutes acceptance of the updated terms. If you disagree with the changes, you may terminate your account.
11. Governing Law
These terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless mandatory consumer protection laws provide otherwise.
